EB-5 Program Investor Requirements

To qualify for the EB-5 program, investors must meet these criteria:

  • Investment Amount: Invest a minimum of $1,050,000 in a new commercial enterprise, or $800,000 in a Targeted Employment Area (TEA), which includes rural or high-unemployment areas.
  • Job Creation: The investment must create or preserve at least 10 full-time jobs for U.S. workers within two years of the investor’s admission to the United States.
  • At-Risk Investment: The funds invested must remain at risk for the duration of the investment.
  • Source of Funds: Investors must prove their investment funds were lawfully obtained, with comprehensive documentation to support their source.
  • Active Participation: While direct management of the business is not required, investors must demonstrate some level of involvement, such as being a limited partner or holding a policy-making role in the enterprise.
  • Compliance with USCIS Regulations: Investors must adhere to all U.S. Citizenship and Immigration Services (USCIS) guidelines and provide necessary documentation throughout the application and investment process.
